Are CASs Breaking the Law Society Rules

Attorney General, Ontario:

I am writing to inform you of the fact that the Ottawa Childrens Aid Society has posted a job ad seeking Law Clerks and in that ad, stating that the Law Clerks will appear before court to represent the corporation when their lawyers can not attend.

Your office has made announcements regarding the protection of the public with the new regulations concerning who can or can and who can not appear before the courts as paid representatives. It it our concern that Childrens Aid Societies appear to be advertising for Law Clerks to appear in court on behalf of counsel in violation of these new regulations, despite the Attorney Generals attempts to protect the public from such unlicesenced, financially compensated representation.

1. I wanted to ask the Attorney General if this is allowed since appearing before a court is only to be done by paid paralegals or lawyers, or if someone is to appear in court on behalf of a corporation as an AGENT, can they do so if they are being financially compensated for doing so.

2. I wanted to ask if the Attorney General will look into this matter and to determine how many of the 53 Childrens Aid Societies in Ontario may be engaging in this illegal practice.

I ask these questions beccause of a recent job posting by the Childrens Aid Society of Ottawa which seeks a Law Clerk to appear in court as an agent on behalf of corporate Counsel while being financially compensated in a full-time position as a law clerk.

One of the points in the duties of their public employment posting states the following.

· Attend court as an agent on behalf of legal counsel when and if required;
